About the Program
After twenty years of practice in the area of mental health law, both at CAMFT and in private practice, and in BBS proceedings as well as civil lawsuits and family law cases, attorney Dave Jensen is amazed how the same sorts of issues keep surfacing.
In this six-hour course, which will meet state requirements for law and ethics, Dave will present these top issues, including what can happen to you and your license if you violate them. He will review principles of law and ethics that are critical for psychotherapists to understand in their practices, including, but not limited to:
- The professional judgment rule
- The Medical Information Act and its new threat to psychotherapists
- Defining the unit of treatment
- Defining the patient
- The issuance of subpoenas, the service of subpoenas and responding to subpoenas
- Creating and maintaining the integrity of the psychotherapist-patient privilege
- Interacting with lawyers, especially in family law cases
- Assessing for suicidality
- Informed consent
- Terminating the therapist-patient relationship
- Communicating with third parties
- Staying out of the BBS' crosshairs and other surprises!
Learning Objectives
At the end of this presentation, attendees will be able to:
- Explain the parameters of the professional judgment rule.
- Explain why it is important to define the unit of treatment in the clinical record.
- Compare proper service of subpoenas with improper service of them.
- Identify three principles to follow when responding to subpoenas.
- Identify the three attributes of privileged communications.
- Identify what causes communications to lose their status as privileged ones.
- Explain why it is now more important than ever to understand the Confidentiality of Medical Information Act.
- Identify three things that must be a part of any consideration of suicidal ideation.
- Identify at least ten ways that an associate or licensee can run afoul of the BBS.
Program Goals
Through the content of this presentation, the instructor sincerely hopes to demystify some of the scarier aspects of law and ethics as well as helping therapists gain confidence in complying with them.
About the Presenter
Mr. Jensen worked in-house for the California Association of Marriage and Family Therapists (CAMFT) for 16 years, assisting members in understanding and complying with their legal and ethical requirements. He has worked 6 years in private practice representing therapists. A popular and engaging presenter, Mr. Jensen has given numerous workshops throughout the state on compliance issues for psychotherapists. In addition, to providing workshops for local chapters of CAMFT, he also conducts trainings for nonprofit agencies, government agencies, and universities. He has also assisted psychotherapists in forming professional corporations and nonprofit corporations.
