During this 3-hour Law and Ethics presentation CAMFT Staff Attorney, Sara Jasper, will describe key issues to address at the outset of treatment with a particular emphasis on the importance of identifying the patient unit of treatment and setting up reasonable expectations within the patient unit. Ms. Jasper will talk about how this can be achieved through a discussion of patient goals, clarification of professional boundaries and competencies as well as key policies and procedures. Ms. Jasper will cover the No Surprises Act and how to discuss Medicare with patients now that LMFTs (and LPCCs) are Medicare eligible. Finally, Ms. Jasper to discuss additional issues to consider when treating patients with disabilities. The legal and practical information covered will help clinicians comply with their Americans with Disabilities (ADA) responsibilities.
The workshop will also address some of the most complex reporting issues therapists face, including: distinguishing between lawful vs. unlawful corporal punishment, when / whether to report consensual sexual activity with and between minors, and how CANRA’s mandated reporting rules apply to sexting between minors.
Educational Goals
Participants will come away from the presentation with legal and ethical information about how to effectively communicate and collaborate with patients at the outset of the therapeutic relationship. Participants can use what they learn to create clarity, for themselves and their patients, about the goals of the therapeutic relationship, professional boundaries, competencies and key policies and procedures.
Measurable Learning Objectives
Upon completion of this workshop, attendees will be able to:
- Identify fundamental issues to raise when establishing therapeutic relationships
- Identify the types of professionals and entities who/that must comply with the No Surprises Act (NSA) and the good faith estimate regulations.
- Describe the requirements for good faith estimates
- Develop policies and practices that comply with the NSA and the regulations related to good faith estimates.
- Use practical ideas and tips for how to address the topic of Medicare with patients.
- Recognize and respond appropriately to legal requirements when establishing therapeutic relationships with clients who have communication disabilities.
- Identify the five categories of child abuse California mandated reporters are required to report
About the Presenter
A member of the State Bar of California since 2008, Sara Jasper, Esq. joined CAMFT as a Staff Attorney in 2011. Before coming to CAMFT, she worked as the Legal Liaison and Administrative Officer for the Sacramento Police Department and as an Associate at Middleton, Young & Minney, LLP where she practiced education and employment law. During law school, Sara clerked for the California Judicial Council, Center for Children, Families and the Courts and for the National Center for Youth Law. Since joining CAMFT, Sara has become a Certified Association Executive and earned her certificate in Nonprofit Organization Management. As a CAMFT staff attorney, Brad takes member phone calls regarding law and ethics issues and contributes articles on those subjects to CAMFT's publication, the Therapist. Prior to joining CAMFT’s legal team, Brad worked on litigation and regulatory matters as an attorney for San Diego Gas & Electric Company.
